Answer
1. ACCOMMODATION
1.1 The descriptions in our brochure and on our website of the properties to let are made very carefully and in good faith. We try to visit properties to ensure the accuracy of descriptions of properties. We also rely upon information given to us by the owners. However, we are not liable for any modifications introduced by the property owners. Should we become aware of any significant modifications, these will be communicated to you as soon as possible. Please see also condition no. 14.
1.2 Properties are let fully furnished and equipped, including crockery, cutlery, bed and bath linen sufficient for the number of people indicated in the Booking Form, but usually excluding beach towels. Fresh linens and towels are provided weekly. Fuel for lighting, cooking, refrigeration and hot water is included in the rental price, but not, except in some houses identified in the price list, fuel for air conditioning or heating, the cost of which must be paid directly to the owner or his representative during the holiday. Cots are often available, but customers are asked to bring their own bedding for these. There is a charge of ÂŁ25 per booking for cots.Should problems arise with the delivery of water, gas, electricity or telephone services, the owner/caretaker of the property will do their best to remedy the situation, but public utilities are frequently affected by weather and other circumstances and neither the property owner nor we can accept any responsibility for non-delivery of utilities due to any circumstances beyond the property ownerâs and/or our control.

2. NUMBER OF PERSONS
2.1 The number of persons who can be accommodated in each property is clearly indicated in each description. âSleeps 4â6â means that the property can accommodate 4 people in double or single bedrooms and 2 more people in additional beds in bedrooms or living rooms. This is further clarified in the text. This number may not be exceeded in any circumstances except by prior consent of the owner, either directly or through our representatives. Often local bylaws or water supplies etc. preclude the possibility of any increase in accommodation, so PLEASE ask before inviting friends! Tents are NOT allowed without the ownerâs permission.

3. MINIMUM PERIOD OF RENT
3.1 Except in the case of pension or hotel bookings the minimum period of rent is one week (in some properties two weeks), and renting starts and finishes on a Saturday, unless otherwise specified in the description of each property. Rentals start at 5 p.m. on the first day and end at 10 a.m. on the last day of the holiday. Guests are asked to arrive between 5 p.m. and 8 p.m., and to leave before 10 a.m. in order to allow the property to be prepared for the next guests. The owner has the right to refuse arrivals outside the above times if he or she finds the alternatives inconvenient. If you find your journey taking longer than you expected, please contact the owner or our representatives in Tuscany and they will contact the owner. This is a very personal business and we do worry about the possibility of accidents!

4. BOOKING & PAYMENT
4.1 Before we can confirm your booking, we will sometimes need to ascertain availability of the property. If the property is available, we will provide you with a BOOKING REFERENCE NUMBER.
4.2 To secure your villa, please send to us, or our representative from whom you obtained the booking reference number, a deposit of 30% of the holiday cost (unless booked within 70 days of your first day â please see clause 4.7), together with the whole of the Personal Travel Insurance Premium (should this be purchased from us), a completed booking form with booking reference number and details of a credit card/debit card to be provided as security (âSecurity Cardâ â please see below for definition). You may pay by cheque (made payable to Invitation to Tuscany Ltd.) or credit card. These must be received within FIVE working days from the date on which availability of the villa was confirmed to you.
4.3 If we are able to accept your booking, we will send you a receipt and invoice by return. The contract between you and the property owner comes into existence on despatch of the receipt and invoice, and on the basis of these terms and conditions.
4.4 The balance of the monies is due no later than 70 days (ten weeks) before the first day of stay at the property. We reserve the right to treat the booking as cancelled if the balance of the price remains unpaid less than 70 days before the first day of the stay at the villa and cancellation terms may apply (please see condition 15).
4.5 Please note that if payments are not received in time, we reserve the right to apply the cancellation charges to the Security Card without notice.
4.6 Receipts will be sent upon receipt of the total invoice price. The invoice price reflects the rental charges as set out in relation to your particular property or properties in our current price list and as confirmed on the booking form and invoice.
4.7 Bookings made within 70 days of the start of the rental must be accompanied by the whole rental cost as well as a completed booking form and booking reference number within 5 working days of receipt by you of the booking reference number. Payment in this case is accepted by credit card or bank transfer only.

5. PRICES
5.1 Prices are in English Pounds Sterling based on the rate of exchange between English Sterling pounds and Euro at the time of going to press. All prices are subject to change until full payment has been received. If, on the day the balance becomes due the value of the pound Sterling has dropped below Euro 1.38 = ÂŁ1:00 we may impose a surcharge to a maximum of 10% of the total rental invoice. You will be notified as soon as possible if it is necessary for us to change the price of your holiday. Should you decide to cancel because of this, you must exercise your right to do so within 14 days of the date of our written communication to you of the price increase. Should you decide to cancel within this time, then no cancellation charges will apply. After this date you will be deemed to have accepted the revised price.
5.2 Payments are accepted in English Pounds Sterling only and may be made by cheque, credit/debit card, bank transfer/wire, bank draft or Switch (U.K. only), in accordance with the restrictions set out in the above schedule.
5.3 We accept Visa, Access, Visa Delta, MasterCard, and American Express credit cards. We do not accept Diners Cards. Payments may be made with a different credit card/debit card from the one provided as security.
5.4 The Final Bill (please see below for definition), which is presented by the owner/caretaker of the rental property at the end of the rental period, must be paid directly to him/her in Euros or Euro âdenominated Travellersâ cheques.
5.5 Please note that if you are booking your holiday from a non-sterling area, such as New Zealand, Australia or USA, you may find enclosed with this brochure a list of comparable prices in your own currency, based on the exchange rate between Sterling pounds and that currency. Any such price list in a currency other than sterling is for guidance only and the sterling price, including any possible surcharges rendered necessary by the conditions above, remains the valid one. Credit card payments by non-British residents will be debited by the credit card authorities to customersâ accounts at the exchange rate on the day of the debit. Foreign currency cheques are only accepted for payment on the understanding that if a foreign currency has gained more than 2% against sterling at the time of encashment of the cheque the customer will pay the difference upon notification. Payments made directly to our bankers MUST bear your Booking Reference number and be transferred stating âwithout charge to the recipientâ. 6. THE PARTY LEADER.
The Party Leader is the person or agency in whose name the booking is made and to whom all correspondence and invoices are addressed and who is responsible for the rental.

7. SECURITY CARD
7.1 A credit/debit card (the âSecurity Cardâ) in the name of the Party Leader must be given at the time of booking as security for the rental and any related charges.
7.2 The Security Card details will be held and will only be debited under the following circumstances (administration charges may apply):-
a. To settle an outstanding balance, invalid or unpaid cheques, or payments not received according to these conditions;
b. To settle amendment or cancellation fees; or to settle cancellation fees for extra services;
c. To settle the Final Bill (please see paragraph 9) if payment cannot be made in local currency or Travellersâ cheques;
d. To settle any invoiced amounts that you specifically indicate should be debited against the card.
7.3 Should you wish to alter the name of the Property Leader or substitute a different credit/debit card for the one provided in the booking form an amended set of booking forms must be completed and signed.
7.4 The Security Card must have a validity that extends a minimum of 15 days beyond the end of the rental period. If the Security card provided expires before that time , a Credit/Debit card Form with the details of the replacement card and signed prior to the expiry date must be provided, failing which the Accommodation documents will not be released.

8. CAUTIONARY DEPOSIT
8.1 Some owners will ask for a Cautionary Deposit to cover any damage or breakages during your stay. We will advise you if such a deposit applies to your property and if so, the level of such a deposit. Some owners prefer to deal with the deposit on your arrival at the property in which case you should hand a cheque or cash to the owner on arrival. We will let you know if payment is required locally.
8.2 On arrival, the owner should show you around the property as set out in paragraph 12. The Cautionary Deposit form should then be signed and/or you should notify the owner of any problems within 24 hours of arrival.
8.3 At the end of your stay, the owner will check the property and will advise you of any further costs, not covered by the Cautionary Deposit, which may have arisen as a result of breakages or damage. Such costs are dealt with in the Final Bill which is explained in more detail below.

9. FINAL BILL
9.1 The Security Card is used to protect owners against breakages, damage and extra costs including extra cleaning, not paid for before departure and not covered by the Cautionary Deposit.
9.2 On the day of departure, the owner/caretaker will inspect the property with you and complete the Final Bill which must be signed by both you and the owner/caretaker.
9.3 The Final Bill will list any specific costs of extra services requested and the unit or daily costs for optional facilities (e.g., telephone, central heating, catering, baby-sitting). Meter readings, if available for utilities not included in the rental price are to be noted here by the owner/caretaker and the client.
9.4 It will also list any additional charges such as extra cleaning, repairs required as a result of damage caused by you as well as the cost of items which could not be specified at the time of departure, such as damages for which the repair replacement estimate / charge have not been received in time.
9.5 Any items on this Final Bill are payable to him/her in ?uros or ?uro denominated Travellersâ cheques. The amount shown on the Final Bill may also be applied to the Security Card on the understanding that a ÂŁ20.00 administration fee will be added to the amount due, and the amount due will be debited against the card in pounds Sterling at the rate current at the time of debit.
9.6 Invoices for any outstanding items will be forwarded to the client as soon as they are received. Please note that the Italian Telephone service only issues bills every two months and so it may be several weeks before this is submitted. These charges may be paid by credit/debit card or bank transfer or by a Sterling cheque drawn on a UK bank.

10. ADVANCE BOOKINGS FOR THE FOLLOWING YEAR
10.1 Many of the owners may accept early bookings at the current yearâs prices and we will confirm the price to you in writing â in this case the booking is treated as per paragraphs 4.2 and 4.4 if it is made outside the 70 day period. However, you must receive written confirmation from us of the ownerâs agreement to the price.
10.2 Should you wish to make an advance booking for the following year but the owner has not finalised the price for the following year and wishes to retain the right to do so, you may make a provisional reservation by sending a completed and signed Booking Form accompanied by a deposit of 20% of the total invoice price for the current year to be received within FIVE working days.
10.3 If for any reason before the price is fixed for the following year the owner decides not to accept your booking, the whole of any amount paid by you as a provisional deposit will be refunded without charge. Once the owner has finalised the price for the following year, the amount of the outstanding deposit under the new price will be advised to you as soon as possible and must be received within FIVE working days of notification of the outstanding amount. If, on notification of the price, you wish to cancel your booking, please advise us within FIVE working days of notification of the new price. In the event that you wish to cancel during this period, no cancellation charges are applicable.
10.4Payments will be accepted in any of the forms described in paragraph 4.2. If payment is not received on time and we have not received notification from you during that time that the rental has been cancelled, the second part of the deposit will be automatically debited against the security card.
10.5If the Booking is being made for the following year, but the initial reservation is received after December 15th, the completed and signed booking form must be accompanied by a deposit of 30% of the total invoice price within FIVE working days.

11. FINAL ACCOMMODATION DOCUMENTS.
11.1 The Accommodation Voucher package, which includes a list of Extra Services requested (if any), driving directions, contact names and telephone numbers, will be provided no later than three weeks before the first day of the rental period provided that full payment has been made. The Voucher will not be issued if essential information, including group composition, is missing in the Booking Form. Errors or omissions in the Accommodation Voucher must be noted and conveyed to us immediately.
11.2 For security reasons, the Accommodation Voucher must be presented and left with the person greeting you at the property or access may be denied. The Voucher package also contains the Final Bill which is to be completed and left with the property owner/caretaker at the conclusion of the rental period.

12. PROPERTY INSPECTION
12.1 On arrival, or as soon as possible after arrival, guests should inspect the property with the owner/caretaker and ensure that they understand the use of any appliances, equipment and utilities. The owner should also read any appropriate meters for heating or telephone use. Please read House Notes carefully before using appliances as frequently Italian appliances are different from those you may be used to at home. Washing machines and dishwashers have a timed safety catch on doors, for instance, which, if forced, may break the door.
12.2 The owner/caretaker will usually arrive at the property at 9 am on the day of departure in order to inspect the property and complete the Final Bill.
12.3 If you intend leaving before 10 am on the last day of your rental period, please notify the owner/caretaker at the beginning of your rental period in order to arrange an alternative time for the property inspection. If you choose not to be present at the inspection you will not be entitled to query the Final Bill and we will automatically debit your security card for any outstanding amount indicated plus the ÂŁ20:00 administration fee.

13. AMENDMENTS TO YOUR BOOKING BY YOU
13.1 Any amendments to bookings, such as a change of dates or properties, must be conveyed in writing as soon as possible in order that we may try to accommodate them.
13.2 In the event of an amendment, we will endeavour to try and accommodate your change with the owner. In the event that the amendment is substantial, for example a change of dates or properties, and any such amendments can be met, the following charges will apply:
âą more than 70 days (ten weeks) before the first day of the rental period an administration charge of ÂŁ20.00 will be debited against the Security Card together with any difference in the cost of the revised arrangements.
âą less than 70 days (ten weeks) from the first day of the rental period, a ÂŁ20.00 administration fee together with the difference in the cost of the revised arrangements will be applied against the Security Card.
13.3 If we cannot amend your booking and you no longer wish to take the original booking, the cancellation charges set out in paragraph 15 will apply.
13.4 Should you wish to shorten your stay after your booking has been confirmed, any refunds will be at the discretion of the property owner.
13.5 If you move independently to other accommodation or alter the duration of your stay without informing the property owner/caretaker or us as a result of a problem or allowing reasonable time for rectification of any problems, then no refunds will be made except at the discretion of the property owner.
13.6 If, after your booking has been confirmed, you wish to transfer it to another person or group, you must advise us as soon as possible. In the event that such a transfer can be accommodated, an amendment fee of ÂŁ20 is payable which is non refundable in the event of cancellation. Any outstanding cost incurred prior to the transfer will be debited from the Security Card provided with the original booking.
13.7 If you arrange any flights for your holiday you should be aware that they are often not transferable and the carrier may impose a charge for making such alterations.

14. AMENDMENTS OR CANCELLATIONS BY THE PROPERTY OWNER
We undertake to notify clients in the unlikely event that the owners are forced to make changes to their confirmed booking once the deposit has been accepted. If the villa owner alters or cancels your booking, we will inform you as soon as possible but we have no liability to make any refunds or to pay any compensation.

15. CANCELLATION BY YOU
15.1 Cancellation takes effect only when written notification is received by us or our representatives from the Party Leader who signed the booking form. Such cancellation notice should be made by recorded delivery or facsimile. Cancellation applies from the date of receipt of cancellation notification by us and we cannot be held responsible if a letter is not received within the cancellation period if there is no proof of posting.
15.2 Notification of cancellation 70 days or less prior to the first day of rental of the property will incur forfeiture of the whole cost of the holiday as well as any insurance premium if purchased through us.
15.3 Notification of cancellation more than 70 days (10 weeks) prior to the first day of rental of the property will incur forfeiture of the 30% deposit for the holiday as well as any insurance premium if purchased through us.
15.4 Bookings made for the following year and cancelled prior to December 15th will incur forfeiture of 10% of the invoice price, provided that the notice of cancellation is received at least 70 days (10 weeks) before the first day of the rental period.
15.5 Although we provide details of airlines operating to the regions included in our brochure, we do not arrange flights and any flight arrangements you make will not form part of our contract with you.

16. INSURANCE
Your signature on the Booking Form is taken as a declaration that you hold a valid travel insurance policy as generally available in Europe. For non-European citizens we highly recommend that you obtain coverage for medical and personal liability, as well as loss of luggage, monies and repatriation.

17. SWIMMING POOLS
Most private swimming pools are not heated and most are open from mid May until mid September, depending upon the weather and the ownerâs discretion. Some public pools are open only for June, July and August.Use of the swimming pool is strictly at the clientsâ own risk and children must be supervised at all times.

18. BREAKDOWN OF EQUIPMENT
In the event of breakdown of mechanical equipment such as pumps, boilers, swimming pool equipment etc, please contact the property owner and inform him of the problem. Should the property owner be unable to be contacted, then you should contact our representative or, as a last resort, our office to inform us of the problem. We shall try to get the fault corrected as soon as possible, but you are asked to bear in mind that it may take some time particularly if it occurs on a Sunday or public holiday. Whilst we will endeavour to assist if the property owner is not available, we cannot be held responsible for such breakdowns as we act only as agents for the property owner. You should be aware that in Italy, occasional problems in relation to public utilities such as electricity and water can be experienced.

19. TIDINESS AND CLEANLINESS
19.1 Properties will be assigned clean and in good order and should be left upon departure in the same condition. Please note that especially during a dry summer, dust collects quickly in old country houses. While guests are not expected to scrub floors, a general sweep and tidy-up is expected. Many owners will arrange for a cleaner if you ask. If the property has not been left in an acceptable state, the owner/caretaker at his/her discretion may add up to Euro 10,00 per person to be added to the Final Bill for the extra cleaning and tidying required beyond that normally expected between a change of guests.

19.2 The Party Leader is responsible for the civilised behaviour of his party. Should the party behave in a manner that is not acceptable the owner/caretaker has the right to ask you to vacate the premises.
20. FORCE MAJEURE
Neither we nor the property owner can accept any liability whatsoever in respect of any alteration, delay or cancellation or any other loss or damage of any kind caused by wars, revolutions, terrorist activities, riots, civil commotions, strikes, lockouts, industrial disputes, natural disaster, fire, floods, storms, failure of public utilities, mechanical breakdown, acts of any Government or Public Authority, changes imposed by rescheduling or cancellation of ferries, railways, airlines which are beyond its control or any other circumstances or events amounting to âForce Majeureâ and/or acts of God.

21. COMPLAINTS
21.1 We hope there wonât be any! If there are any problems, it is your responsibility to notify the owner/caretaker of the property promptly so that he/she can take the action required.
21.2 The owners must have an opportunity to put right any issues as soon as they arise. Should the owner not be available, please contact our representatives and they will endeavour to contact the owner.
21.3 In the unlikely event you are dissatisfied you must in the first instance contact the owner or the keyholder of the property to try to remedy the situation. We cannot be held liable for any dissatisfaction with the holiday unless any such liability is in accordance with paragraph22.

22. LIABILITY
Given that we act only as agents for the property owners, we can accept no liability whatsoever for any death, personal injury, loss or damage of any kind, unless caused by our own negligence. Insofar as we have any liability to you, then proceedings in respect of any such liability shall be governed by English law and the exclusive jurisdiction of the English courts. Service of any such proceedings should be upon us at Queenâs Wharf, Queen Caroline Street, London W6 9RJ.

23. BREAKAGE/DAMAGE
23.1 The Party Leader is liable for any damages caused to the property, its contents or the grounds by any member of his party. You are are asked to tell the owner, caretaker, or our representatives, about any damage or breakdown AS SOON AS IT OCCURS, so that replacements or repairs can be effected as soon as possible. These are private homes.
23.2 Please respect the trust which the property owners have afforded to you: look after the property while you are there as you would your own home, and please do not remove books or any other private items.

24. PETS
No pets are allowed without the express permission of the owner of the property concerned. There may be a charge for pets and this should be paid directly to the owner of the property concerned with the Final Bill.

25. NOISE
Almost all our properties are in quiet, peaceful country situations. However, in the country you are likely to hear birds, nightingales, owls, dogs, sheep bells, poultry, insects, frogs, tractors etc. all making sounds which are different from those in the city and which may disturb unaccustomed ears. We suggest that you take earplugs if you feel that these country sounds may disturb your sleep. Villages regularly hold festivals during the summer, which can be very noisy until late at night. The best way to support this is to join in and enjoy the feasts. We accept no liability for noise or disturbance experienced whilst at the property.

26. ACCESS ROADS
Isolated country properties are often reached by rough and bumpy roads. If you intend driving your low slung or sports car to the rental property, please ask about the access roads to your chosen property.

27. INSURANCE, CAR HIRE AND OTHER ANCILLARY ARRANGEMENTS
When insurance, car hire or any ancillary service is arranged through us, we act as agents for the companies concerned. We are therefore not liable for death or personal injury or losses and damages arising from such unless caused by our negligence. We are not responsible for any alterations, including prices, surcharges etc. which those companies may make although we will try to advise you as soon as possible of any such amendments.

28. OTHER SUPPLIERSâ TERMS AND CONDITIONS
28.1 We do not arrange air travel, ferry travel or rail travel.
28.2 However, for air travel, we are happy to assist customers by passing on details of airlines which operate flights to the areas covered by our brochure. Please note that should your holiday include arrangements for air travel, we will not accept any money for nor enter into any contracts on behalf of any parties for such travel. Please be aware that any such air travel is subject to international conventions. We can assist you in respect of car hire and we have an arrangement with EuropCar whereby customers booking properties through us can also arrange car hire at the same time. We act as the booking agent for the car rental broker that supply the vehicle(s) you rent, and as such, bookings for these services will form a direct contract between you and the car rental broker, and will be subject to the car rental brokerâs terms and conditions.
28.3 Should we make any arrangements on your behalf with third parties for services, we will do so on the basis that it is as an agent to the contract and any contract is between you and the supplier. We will have no liability to you in relation to such arrangements unless it involves personal injury or death which is caused by our negligence.

29. CHOICE OF LAW AND JURISDICTION
29.1 Insofar as we have any liability to you, then proceedings in respect of any such liability shall be governed by English law and the exclusive jurisdiction of the English courts.
